PERB has released its annual report for fiscal year 2019-2020. (The report is available here.)  Here is my annual summary of the statistics in the report:

Unfair Practice Charges

547 unfair practice charges (UPCs) were filed in fiscal year 2019-20. This is a 20.8% decrease from the 691 UPCs filed in fiscal year 2018-19. In terms of the break-down by Act, the MMBA decreased from 289 to 223 UPCs. EERA decreased from 279 to 192 UPCs. The Dills Act increased from 31 to 43 UPCs. HEERA decreased 73 to 68 UPCs. The Trial Court Act increased from 1 to 8 UPCs.  The Trial Court Interpreter Act also increased from 1 to 8 UPCs. There was 1 UPC filed under the Los Angeles County Metropolitan Transportation Authority Employer-Employee Relations Act, and 3 UPCS designated non-jurisdictional.

ALJ Proposed Decisions

In 2019-20, the ALJs at PERB issued 53 proposed decisions. This is decrease of 1 decision from the 54 proposed decisions in 2018-19. The average time it took to issue a proposed decision in 2019-20 was 117 days, a 32.8% decrease from the average 174 days it took to issue a decision in 2018-19.

Board Decisions

For 2019-20, the Board itself issued 101 decisions and considered 19 injunctive relief (IR) requests. The 101 decisions are a 9.8% increase from the 92 decisions issued in 2018-19, while the 19 IR requests are a decrease from the 25 IR requests in the prior year.

Factfinding Requests

In fiscal year 201-20, there were 19 requests approved for factfinding under EERA and HEERA. Last fiscal year there were 101 requests approved. However, in the year prior to last there were 33 requests approved so last year may have been an outlier. Under the MMBA, 40 factfinding requests were filed all of which were presumably approved. Last fiscal year there were 48 requests, of which 36 were approved.
